The traffic school election is Florida's most useful ticket remedy, and it is also rationed: drivers who assume they can elect their way out of every citation eventually meet the 12-month clock or the lifetime cap at the worst possible moment - usually at a clerk's counter with 29 days left on a 30-day election window. The rules are short, but two of them changed in recent years and a lot of older guidance still circulates the wrong numbers. What Counts Against the Cap - and What Does Not
- Counts: any voluntary election of a FLHSMV-approved Basic Driver Improvement course for a non-criminal moving violation. The election is the act that consumes the slot, not the course completion - which is one reason to be sure before you elect.
- Does not count: courses you were ordered or required to attend. A judge-ordered 8-hour intermediate course, a court-mandated BDI, and the mandatory courses for signal violations, failure to stop for a school bus, racing, and reckless driving under Section 322.0261 all run on separate tracks.
- Does not count: the wireless communications device course - the school-zone and work-zone handheld-phone election - which is its own program with its own rules.
- Edge case: electing and then not completing the course. The election was still an election; the citation's points return if the court-required completion is not met, and the consumed slot does not refund itself.
Eligibility: The Ticket Has to Qualify Too
The caps are one half of the math; the citation is the other. An election is available to a driver who receives a non-criminal moving violation and who does not hold a commercial driver license. Speeding, running a signal, careless driving, and most everyday citations qualify. What does not:- Criminal violations - DUI, reckless driving charges, hit-and-run - which run through the courts, not the election window.
- CDL holders' violations - commercial drivers cannot elect school for qualifying violations regardless of the lifetime count.
- Tickets received while electing elsewhere - the 12-month spacing applies to the second citation no matter which county issued it.
Strategy: Spending Eight Elections Over a Lifetime
- Save elections for tickets that would actually cost you points. Points are what raise insurance and stack toward suspension at 12 points in 12 months - a ticket that carried no points anyway is a wasted election.
- Count before you elect. If your last election was 11 months ago, waiting a few weeks preserves the 12-month spacing instead of burning a lifetime slot on a ticket you could dispute or pay.
- Watch the 30-day clock while deciding. The election window and the fine payment window are the same 30 days - deciding too long forfeits the option entirely.
- Budget the cost honestly. Approved online courses are inexpensive - Florida's largest providers run the 4-hour BDI course in the single digits on promotion plus state-assessed fees - but the fine is still owed, so the election buys points protection, not a free ticket. Checking Your Own Count
Florida does not push election history to you - the ledger lives in your driving record and the clerk systems that processed past elections. Before electing, two quick checks settle the count: your FLHSMV driver license check shows convictions and course completions that imply elections, and your county clerk can see election records for citations it processed (previous counties' elections will not appear there, so reconstruct from your own history if you moved).
